On October 22, the ICJ issued a legal opinion stating that as the occupying power, Israel has an obligation to cooperate with UN agencies to facilitate humanitarian assistance in Gaza, Press TV reported. At the same time, Israel “also has a negative obligation not to interfere with the provision of these supplies,” the court said.
In a post on X on Saturday, Bagai said the ICJ opinion once again exposes “the undeniable truth that the Israeli regime remains a grave violator of all norms of international humanitarian law.”
He noted that the court reaffirmed Israel’s obligation to ensure the basic needs of Palestinians living under occupation, including supplies essential to their survival, and stressed that the regime must not obstruct the provision of such supplies.
He added that the ICJ recalled that international law prohibits the use of starvation as a means of war.
Bagai also referred to the court’s previous opinion reaffirming that the occupation of Palestinian land is “illegal” and must stop.
He said the Israeli regime has consistently defied these principles and has been accused by both the ICJ and the International Criminal Court (ICC) of committing war crimes, crimes against humanity and genocide in Gaza.
In July 2024, the ICJ issued another advisory opinion declaring that Israel’s occupation of the Palestinian territories is “illegal” and should be stopped without delay.
The ICJ is also currently reviewing a case brought by South Africa alleging that Israel violated the 1948 United Nations Genocide Convention through its actions in Gaza.
Israel launched a genocidal war in Gaza on October 7, 2023, after the Palestinian Resistance Army launched a military operation against the regime due to escalating violence against Palestinians in the occupied West Bank.
According to the Gaza Ministry of Health, the war has left at least 68,280 people dead, mostly women and children, and 170,375 injured.
